Simon, I did not read from the article that you implied JXTA team is unprofessional. :-)

When it comes to license, I am with you we should all try to use existing OSI licenses. It's very true that each license tried to address some issues not covered by other licenses. As the licenses are evolving, it is much more likely to pick one can match the needs of a project.

I joined JXTA team in Dec, 2004, so I don't know much of the history. But looking at the JXTA license, it is basically an Apache 1.1 license with names replaced. Personal opinion, I would like to see JXTA been re-licensed under Apache 2.0, which seems to be a natural fit.

Why not just use the CDDL - it's a basically good license. Stop wasting creativity on things that don't differentiate you.

I would love to use CDDL, but I believe the reason JXTA chose Apache is because it's BSD style and offer maximum freedom(even allow you to keep modifications) for developers. Anyway, this is my personal opinion, and I want to see JXTA everywhere. If it is my decision, it will be triple licensed under LGPL/CDDL/Apache2.
