The use of patent grant in Free/Open Source Licenses such as Apache Software License Version 2.0, Common Development and Distribution License Version 1.0, soon GNU Public License Version 3 and patent covenants for standards/specifications are good, it provides assurances along with a pragmatic short solution to the software patent problem until patent reform happens.
Software patents damages the economy, competition and innovation, there are many examples of this.
The world's largest patent holder has granted patents for Free/Open Source Software (FOSS) but if any FOSS project that does use patents not granted by world's largest holder, the FOSS project may be subject to patent lawsuit. The world's largest patent holder does assert its patents.
The efforts of Patent Commons and Open Invention Network are merely attempts to legitimise software patents and the so called Mutually Assured Destruction (MAD).
It should be noted that the world's largest patent holder also lobbies for software patents in Europe.
I also believe the world's largest patent holder strategy is to limit areas of development among FOSS projects.
I have huge concerns about the world's largest patent holder.
